Our Group Managing Partner in September 2018 delivering an opening statement at the preliminary hearings of the Infected Blood Inquiry.

Ireland

1. The advancement and successful conclusion of Quinlan -V BTSB relating to Aggravated & Exemplary Damages where liability for ordinary damages had been eventually admitted prior to the hearing date relating to the infection of Anti-D Immunoglobulin with Hepatitis C.

2. The Finlay Tribunal of Inquiry (a public Statutory Inquiry) into the infection of the Irish Blood supply system with Hepatitis C and in particular Anti-D Immunoglobulin in Ireland.

3. The setting aside of the 1991 HIV settlement with the Haemophilia Community in Ireland on the basis that it was neither fair nor equitable.

4. The Lindsay Tribunal of Inquiry (a public Statutory Inquiry) relating to the contamination of Blood and Blood products with both HIV & Hepatitis C infection relating predominantly to the Haemophilia community.

5. The negotiation, drafting and establishment of a HIV & Hepatitis C Compensation scheme for both those infected and affected relating to both HIV and Hepatitis C infections which culminated in the passage of negotiated legislation termed the Hepatitis C Compensation Tribunal Act 2002 and regulations so arising.

6. The advancement of Hepatitis C & HIV claims before both the Irish High Court and the Compensation Tribunal where the cost of provision of fair and equitable compensation to date has exceeded 1.2 billion euro.

Other Jurisdictions

1. Advising Japanese Lawyers on HIV litigation proofs (photos).

2. Assisting the Royal Canadian Mounted Police in the advancement of a criminal prosecution against a Pharmaceutical Company relating to an inadequately heat treated Factor VIII concentrate.

3. Drafting submissions to New Zealand Government, assisting and making oral submissions to New Zealand Government on behalf of the Haemophilia Federation New Zealand, relating to Hepatitis C Compensation entitlements and more particularly the requirements for the amendment of the ACC scheme.

4. Lecturing throughout the world on the necessity for independent investigations alternative Compensation Scheme processes relating to Viral infections.
